Pravci razvoja kontrole koncentracija u EU i Republici Srbiji

Apstrakt
U martu 2021. godine, Evropska komisija objavila je Uputstvo o primeni mehanizma upućivanja iz člana 22 Uredbe o koncentracijama na određene kategorije predmeta. Ovo uputstvo omogućava Komisiji da nadzire koncentracije koje ne ispunjavaju EU ili nacionalne pragove za prijavu koncentracije.
Evropska komisija će početi da prihvata zahteve za upućivanje takvih koncentracija koje podnose nacionalna tela za zaštitu konkurencije u Evropskoj uniji, što znači da je promenila svoju praksu zbog uočene pravne praznine u pogledu koncentracija koje potencijalno narušavaju konkurenciju, jer do sada takve koncentracije nisu bile predmet njene kontrole .
Da bi bile upućene Evropskoj komisiji, koncentracije moraju uticati na trgovinu između zemalja članica i pretiti da će značajno uticati na konkurenciju na teritoriji zemlje članice ili zemalja koje podnose zahtev.
