The use of artificial intelligence in court proceedings
Main Article Content
Abstract
Technological development in all areas of social life has resulted in innovations in terms of the functioning of complex systems, such as the judiciary. In this regard, legislators and judges are facing new challenges and modern trends in socio-technological development. In academic and media circles, more and more attention is being paid to the possibility of using artificial intelligence in order to improve the efficiency of the judiciary, primarily through the automation of court proceedings. In principle, the automation of court proceedings is achieved by creating different systems of artificial intelligence that contribute to trial and decision-making. Discussions on the issues of legal regulation of the use of artificial intelligence in court proceedings, methods of its use, control and consequences for individuals and society, are current in scientific circles and supported by the state authorities of developed countries. Precisely because it is necessary to use artificial intelligence in court proceedings in a responsible manner, with mandatory protection of basic human rights, in this paper we paid special attention to the presentation and analysis of ethical principles of the European Ethical Charter on the use of artificial intelligence in judicial systems adopted by the European Commission for the Efficiency of Justice, a body of the Council of Europe, with examples of good comparative legal solutions.
